Management of information risk safety as an obligation
The recent motion by the government to enact an act implementing criminal liability of legal entities filed, which should come into force from 1 January 2012, created a stir among the Czech criminal law experts and among representatives of business companies. The institute of corporate criminal liability is a new element in the Czech legal system, and this element should co-exist with the traditional criminal law conception based on individual criminal liability of physical persons.
Pursuant to the aforementioned act, legal entities would assume liability for criminal acts committed by their employees, if the competent control bodies or persons did not take measures they should have taken. However the company's own employees are often the most serious threat to safe operation of a company.
